Terms of Service

1. Agreement to terms
By accessing or using WhoClickedIt (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
2. Beta status
The Service is currently provided as a beta, and may contain bugs, errors, outages, inaccurate reporting, or incomplete features. The Service may change or be discontinued at any time without notice.
To reduce privacy risk, the Service is designed to minimize data collection, including stripping URL query strings by default and recording only event types for email/phone link clicks, but the Service may still produce incomplete or inaccurate analytics due to factors outside our control (including customer website configuration, browser behavior, blockers, connectivity, and third-party systems).
3. No professional advice
The Service provides analytics, reporting, and optional insights/suggestions. Nothing in the Service is financial, legal, business, compliance, or professional advice.
You acknowledge and agree:
- Any decisions you make (including marketing, product, operational, financial, or other decisions) are your responsibility.
- You must independently verify outputs before acting on them.
- We are not responsible for losses arising from actions you take based on the Service’s data, dashboards, reports, or suggestions.
4. No warranties (as-is / as-available)
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, including accuracy, reliability, availability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The Service will be uninterrupted or error-free,
- Analytics will be complete, correct, or timely,
- Any issues will be corrected.
5. Limitation of liability
To the maximum extent permitted by law:
- We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, goodwill, data, business opportunity, or expected savings.
- Our total aggregate liability for any claim relating to the Service is limited to the amount you paid us for the Service in the previous 12 months. (If you paid $0, our liability cap is $0.)
6. Your responsibilities (customers using the tracker)
You agree that you:
- Are responsible for how you deploy the tracking script and for the content of your websites and campaigns.
- Will comply with all applicable laws (including privacy, surveillance, cookie/ePrivacy, spam/marketing, and consumer laws) and will provide any required notices/consents.
- Will not use the Service to track sensitive categories of data or to identify individuals.
- You (the customer) agree not to intentionally send personal information to the Service through URLs, page paths, custom event fields, or other data payloads, and you are responsible for implementing any necessary notices/consents on your websites.
7. Prohibited uses
You must not:
- Use the Service for unlawful, deceptive, or harmful purposes;
- Attempt to reverse engineer, interfere with, or disrupt the Service;
- Upload or transmit malware, or attempt unauthorized access;
- Use the Service to collect or infer personal data in a way that violates applicable law.
8. Accounts and security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. The dashboard uses authenticated access and identifies your account user. We may suspend or terminate accounts suspected of abuse or security risk.
9. Data and ownership
- You retain ownership of your business data and content you provide.
- You grant us a limited license to host, process, and display your data solely to provide and improve the Service.
- We may generate aggregated, de-identified analytics about Service performance and usage.
10. Third-party services
The Service relies on third-party services (including Firebase/Google infrastructure). We are not responsible for third-party outages or failures.
11. Suspension and termination
We may suspend or terminate your access immediately if:
- You breach these Terms,
- You create security risk or legal exposure,
- The Service is discontinued or materially changed.
You may stop using the Service at any time.
12. Changes to the Service or Terms
We may modify the Service or these Terms at any time. If you continue using the Service after changes are posted, you accept the revised Terms.
13. Indemnity
You agree to indemnify and hold harmless us and our affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:
- Your websites and tracking deployment,
- Your failure to obtain required consents/notices,
- Your breach of these Terms or applicable law,
- Your decisions/actions taken based on the Service.
14. Governing law and disputes
These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria, Australia, subject to any non-excludable rights you may have under applicable law.
